What are the ADU rules in Bakersfield in 2026?

Updated October 2026

As of October 2026, Bakersfield's ADU materials allow detached ADUs up to 850 sq ft with one bedroom and 1,200 sq ft with two, attached ADUs up to half the home's size, and 4-foot side and rear setbacks. State law adds no owner-occupancy rule for ADUs, no impact fees at or under 750 sq ft and a 60-day decision deadline.

Each rule here is stated as of October 2026. City figures come from Bakersfield's ADU program materials and its 2024 ADU resource guide; state rules come from the HCD ADU Handbook updated March 2026. Where the city's materials predate a state change, state law controls.

How large can a Bakersfield ADU be?

  • Detached: up to 850 sq ft for one bedroom and up to 1,200 sq ft for two, per the city's ADU FAQ.
  • Attached: the same bedroom limits, capped at 50% of the main home and never over 1,200 sq ft. State law still guarantees at least 850 sq ft, or 1,000 sq ft with more than one bedroom.
  • Junior ADU: 150 to 500 sq ft, inside the existing home or attached garage.
  • The city's FAQ says garage, shed and storage areas are left out of size calculations.

What are the setbacks and height limits?

Side and rear setbacks are 4 feet, and front setbacks follow the zone. A converted freestanding structure can keep its existing position. The 2024 resource guide lists a 10-foot separation between structures for detached ADUs, and height limits by zone of up to 35 feet in R-1 and R-2 and up to 45 feet in R-3 and R-4. State law guarantees at least 16 feet for a detached unit.

Is parking required?

Sometimes. The city's materials call for one space, which may be tandem, unless the ADU is within half a mile of public transit or a garage is converted or replaced. As of October 2026, state law adds more exemptions: no parking can be required for an ADU in an architecturally and historically significant historic district, one created inside the home or an existing accessory structure, one in an area with on-street permits not offered to the occupant, or one within a block of a car share vehicle.

What are the junior ADU rules?

A junior ADU needs an efficiency kitchen and may share the main home's bathroom. It is allowed on single-family lots only, one per lot, and can be paired with a detached ADU. Bakersfield's materials say the owner must live in the house or the JADU. Under state law as of October 2026, that requirement can only apply when the JADU shares a bathroom with the main home; give it its own bathroom and owner occupancy cannot be required.

Do I have to live on the property with an ADU?

No. Bakersfield's FAQ states the city does not require owners to live on a property with an ADU, and as of October 2026 state law (AB 976) prohibits owner-occupancy requirements on ADUs.

Can I use an ADU as a short-term rental?

No. The city's 2024 resource guide says short-term or vacation rentals of under 30 days are not allowed, and state law separately requires junior ADU rentals to exceed 30 days.

What about multifamily lots?

The city's 2024 guide allows interior ADUs in non-living space, up to 25% of the existing units, plus up to two detached ADUs. As of October 2026, the HCD Handbook describes state law allowing up to eight detached ADUs on a lot with an existing multifamily building, not more than the number of existing units. We confirm the current count with the city for any multifamily lot.

What changed statewide for 2026?

HCD summarizes the 2025 bills that took effect for 2026: size measured as interior livable space, the 15-business-day completeness check, impact fee thresholds of 750 sq ft for ADUs and 500 sq ft for JADUs, JADU owner occupancy limited to shared-bathroom units, rentals longer than 30 days for JADUs, and a 60-day review period in the coastal zone.
